New Vietnam Immigration Laws take effect January 1, 2015
Pursuant to new immigration laws passed by the National Assembly of Vietnam, the Immigration system in Vietnam will have several changes effective from January 1st, 2015.
New visa classification structure
Pursuant to visa code, which entered into effect on 1 January, 2015, Vietnam visa is divided into 20 categories instead 10 as previously. Accordingly, the foreign nationals have to apply for a visa based on their intended travel purpose. Please review the brief description of each visa classification in the chart below and choose the visa that most closely matches the purpose of your travel:

Attention:
· The passport of foreign applicants must be valid at least 1 month beyond the period of validity of the visa. After the visa expires, the foreigners can apply for a new visa to re-enter Vietnam.
· People interested in entering Vietnam under the DT, LD and DH categories must provide documentary evidence of the purpose of the visit.
· There is no limit on the number of entries for foreigners entering Vietnam under the unilateral visa exemption program. However, there must be a gap of at least 30 days between two visits.
· Foreign visitors are no longer permitted to change their visa category from within Vietnam. The foreigners must exit Vietnam and apply for a new visa if wishing to change visa status.
New entry and exit restrictions
In attempt to establish entry and exit policies that give more clarity to foreign nationals, the Vietnam government just offered greater restrictions on entry and departure.
The foreigners are not permitted an entry into Vietnam in the following cases:
· He/she was deported from Vietnam within the last 03 years
· He/she was compelled to leave Vietnam within the last 06 months
· He/she presents false information or documents to obtain entry/exit/resident permit
· He/she is under 14 years and travelling without an accompanying parent or guardian.
Foreign visitors are prohibited from departing Vietnam for up to 3 years in the following case:
· He/she hasn’t fulfilled tax obligations in Vietnam
· He/she is obliged to comply with an administrative sanction
· He/she has been criminally charged
· He/she is a party to judicial proceeding
As instructions on the implementation of the new law have yet to be provided, the companies sponsoring foreign employees should keep up-to-date with information on how Vietnam government will implement the laws to well-prepare for the application of work permit.
